These terms and conditions apply to all users of the Gay2Share.com website (Website), including users who submit videos and other content to the Website. By using this website you consent to these Terms and Conditions including the conditions of the Privacy Policy of the Website.
1. Intellectual Property:
All content (Content) on the Gay2Share.com Website, other than User Submitted Content, are owned by or licensed to Gay2Share.com, and are made available to you for your personal use only, and may not be reproduced, displayed, published, sold or otherwise used in any form, for any other purpose.
2. User Submitted Content
Gay2Share.com invites you to submit videos and other information, including user name (User Submitted Content) that it may host, publish and/or share on the Website. You accept that Gay2Share.com does not guarantee any copyright protection or unauthorized use of such content. You further agree and confirm that:
(a) you are solely responsible for the consequences of publishing the contents submitted by you,
(b) you have the intellectual property rights, license and/or authority to publish such content,
(c) you have the necessary permission from every person identifiable in such content to use the name/likeness of that person for the purpose of User Submitted Content to the Website,
(d) you grant to Gay2Share.com a non-exclusive, royalty free, transferable license to use, reproduce, generate derivative works, and publish through any media the content submitted by you,
(e) you also grant to every other user of the Website a license to access your User Submitted Content through the Website, to use, reproduce, generate derivative works, and distribute such content as permitted through the functionality of the Website,
(f) you will not submit any material that is false, illegal, obscene, defamatory, harassing, racist, inciting criminal activity, and sexually, religiously or ethnically offensive,
(g) You will not submit material that solicit business for commercial gain,
(h) Gay2Share.com does not endorse any User Submitted Content or any opinion, representation or recommendation expressed therein,
(i) Gay2Share.com will remove any User Submitted Content that breaches any of the above conditions. Gay2Share.com reserves the right to remove any User Submitted Content without prior notice for whatever reason.
3. Permitted uses:
You agree that Gay2Share.com grants you access to the Website on condition that:
(a) you use the site solely for personal and non-commercial use,
(b) you may register as a registered user (User) prior to being given access to some features of the Website,
(c) you must provide accurate information when you register, and keep your User account (Account) password confidential and secure,
(d) you must not use the User Account identification password of another User,
(e) you are allowed to set links to the content on the Website solely for personal and non-commercial use,
(f) you are allowed to embed the Gay2Share.com Video URL (Permalink), and the Gay2Share.com Embeddable Player into your own personal, non-commercial website to access the User Submitted Content on the Website, provided that a visually prominent link back to the Website is included in the pages with the player embedded,
(g) Gay2Share.com is not responsible to you for consequences arising from your use of the Website,
(h) you will notify Gay2Share.com immediately upon becoming aware of any unauthorised use of your Account,
(i) you will not use any automated process to access the Website at a rate that is beyond humanly possible by means of conventional web browsers,
(j) you will not gather any personal identity information from the Website, eg. User names,
(k) you will not use the communication facilities in the Website to solicit any user for any commercial purposes,
(l) you will comply with all terms and conditions for the use of the Website,
(m) you agree to indemnify Gay2Share.com, its directors, officers and agents against any and all claims, damages, losses and liabilities arising from your use of the Website, and
(n) you confirm that you are over 18 years in age, or having received parental or guardian permission, are competent to accept these terms and conditions.
4. Disclaimer:
Gay2Share.com is not responsible for the accuracy, reliability, safety, legality, social and moral acceptability, or intellectual property rights of User Submitted Content. Gay2Share.com makes no warranty or representation on the accuracy or reliability of the Content of the Website or the content of any website linked to this Website and assumes no responsibility or liability for:
(a) any inaccuracy of the Content,
(b) any losses, personal injury or property damage suffered resulting from the use of the Website,
(c) any unauthorised access to our servers and any personal information stored therein, and
(d) any viruses or similar transmissions that may be transmitted through our website by any third party.
Gay2Share.com makes no endorsement and assumes no responsibility for any product or service advertised by a third party through the Website. To the extent allowed by law, Gay2Share.com, its directors, officers and agents disclaim all warranties, express or implied, in connection with the Website and your use thereof.
5. General:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Victoria and the Commonwealth of Australia. Gay2Share.com reserves the right to amend these Terms and Conditions as and when necessary from time to time.
6. Competitions:
Please read these competition rules carefully. If you enter the "Gay2Share aussieBum Competition" competitions, we will assume that you have read these rules and that you agree to them.
- Persons may enter as many times as they wish but only one voucher will be given per name and mailing address.
- The winners will be the entrants who upload the most clips as of 11.59 pm on the 15th of November 2007 EST –(Aust) those who tie-break the number of upload will be selected by the best of those entries by the judges.
- Each upload must be unique in content and will be determined at the judges descretion.
- The panel of judges for the competition will be comprised of members of Gay2Share.com’s marketing team.
- If you win a competition, we will notify you by e-mail. You will then be required to supply a mailing address to receive your prize. The judges’ decision will be final, and no further correspondence will be entered into.
- By entering the competition the winner agrees to participate in such promotional activity and material as Gay2Share.com may require.
- The prize will not be transferable to another person.
- No part of a prize is exchangeable for cash or any other prize. The prize value is stated in Australian Dollars .
- If an advertised prize is not available, we reserve the right to offer an alternative prize of equal or greater value.
- Incorrectly completed or entries that do not fit within the Gay2Share.com upload guidelines will be disqualified.
- This competition is being run by Gay2Share.com
- Please read our Privacy Policy which tells you how we use any personal information we may collect about you by entering a competition.
- Gay2Share.com reserves the right to amend these rules at any time.
- Gay2Share.com may also create rules which will apply to a specific competition only. If we do this we will publish the amended competition rules and/or specific competition rules on the relevant competition page.
- Gay2Share.com will endeavour to send prizes within a month of the competition end date but cannot guarantee this delivery time.
7. Sharing The Rewards
What is Sharing The Rewards?
Gay2Share.com is pleased to introduce the Sharing The Rewards program to all of its current and future members.
Gay2Share.com will allocate up to 20% of its advertising revenue (net of taxes, all sales and affiliates expenses and commissions) earned and received to be distributed amongst all Eligible Registered Members. The percentage to be applied for allocation to Eligible Registered Members at the end of each calendar month will be calculated as follows:
Where the number of total Eligible Registered Members at the end of each calendar month = X
Where total Registered Members at the end of each calendar month = Y
The percentage to be allocated for distribution in each calendar month= 20% x X/Y
Definitions:
Eligible Registered Member to 'share in the rewards' for a given month must have logged into the site a minimum of 15 times over 15 different days in that particular month.
A Registered Member of the site is someone who has created a user name and password and registered on the website via the appropriate registration form.
The website generates advertising revenue in many ways; simply interact with the website, or click on any advertiser banner. The greater the traffic and interaction, the greater share pool there will be.
To be eligible:
- A registered Gay2Share.com member MUST log into the site for a minimum of 15 times over 15 different days within 1 (one) calendar month (Australian Standard Time) AND view at least 1 (one) clip within each login session. Upon doing so 1 (one) login credit is allocated to the member.
- Only 1 (one) credit is allocated to each member per day per unique login and video view.
- For all new members, logins are counted from the moment of registration.
- For all existing members, logins are counted from the launch of the Sharing The Rewards program.
- Members of Gay2Share.com automatically reap the benefits of the Sharing The Rewards program.
- All login counts are set to zero at the end of each calendar month.
- Login credit tallies DO NOT carry over into the next calendar month.
- All payments to eligible members are made in lots of $AUD100.00 amounts.
- Amounts under $AUD100.00 will be treated as credits and will be carried forward to the following calendar month, until such a point where a payment is made, after which all unpaid credits will be carried forward.
A registered member’s profile page will show the member, once logged in, how many credits have been accumulated/earned in past months, and will show how many current login counts have been accumulated within the current period.
So remember, it requires only 15 logins per month. Make sure you watch a clip each time you login and you will be sharing in the revenue pool.
Terms and Conditions
- Gay2Share may suspend or terminate the Sharing The Rewards program without notice for any reason including, without limitation, if the member fails to comply with the terms and conditions of membership. Gay2Share will not be responsible for any credit balance in a member’s account at the time of suspension or termination.
- Gay2Share reserves may make any change at any time without prior notice to the way the program is conducted and to these terms and conditions.
- A member may terminate his or her participations in the program by giving notice to the site.
- Any tax liability arising from a member’s participation in the program is the responsibility of the member.
- Any foreign currency conversion or other bank charges levied by the member’s bank is the responsibility of the member.
- Credits allocated to a member cannot be sold, transferred or assigned.
